Abstract

In 2005, the 79th Texas Legislature passed H.B. 1294 which amended the interlocuatory appeal provision of § 52.014, Civil Practice and Remedies Code.

The Senate Research Center summarized the bill as follows: "Section 51.014, Civil Practice and Remedies Code, authorizes an appeal of an interlocutory trial court order presenting a controlling question of law if an immediate appeal from the order may materially advance the ultimate termination of the litigation. The statute requires agreement of the parties before the appeal can be taken and before a stay pending appeal can be imposed. Texas courts of appeals have shown confusion about the procedure for taking a permissive appeal under Section 51.014."

The Legislative History of H.B. 1294 follows the bill from its filing through its passage by the House and Senate. Each step of the legislative process is explained in the narrative and the report includes all of the legislative docuemnts available and transcripts of all of the public hearings and floor debates.
