Abstract

The Texas Legislature passed S.B. 25 as one of several tort reform measures in 1995. S.B. 25 related to the limitation of punitive damages. It included an amendment to § 41.008, Tex. Civ. Prac. & Rem. Code, which created a formula for calculating the punitive damages limit: two times "economic damages" plus up to $750,000 of "non-economic damages." The question of this report is whether the Legislature intended for settlement credits to have an effect on the calculation of punitive damages.During the Regular Session of the 74th Texas Legislature, Senate Bill 32 (S.B. 32) was passed which amended Chapter 41, Texas Civil Practice and Remedies, regarding venue.
