Abstract

Numerous bills were filed beginning in 1973 to create an agency to enforce employment discrimination law. Finally in 1983, the Legislature enacted legislation creating the Texas Commission on Human Rights, which was placed in the Texas civil statutes as art. 5221k. Sec. 7.01 of that article provided for judicial action and enforcement in employment discrimination cases.

In 1993, H.B. 860 was passed to conform the Human Rights Commission Act to the Civil Rights Act of 1991 and the American with Disabilities Act. A new subsection (e) was added to Sec. 7.01 which provided for compensatory and punitive damages which was similar to 42 U.S.C. 1981a(b). There was no legislative discussion of this provision.
Also in 1993, the Legislature created the Labor Code in a nonsubstantive codification. The Human Rights Act was revised and placed in Chapter 21.

In 1995, H.B. 860 from 1993 was brought into the Labor Code with the passage of S.B. 959, which was also a nonsubstantive enactment. (In a nonsubstantive enactment such as this or the codification of the Labor Code in 1993, the testimony typically put on is for the purpose of proving up that the revisions are nonsubstantive, rather than discussing the substance of the provisions.)
