Abstract

The Texas Legislature passed personal injury protection auto insurance coverage with the passage of H.B. 143 in 1973.

The House committee summarized the bill as follows:

Background Information It is felt that inclusion of this type of coverage is needed to provide adequate medical and accident benefits.

What the Bill Proposes to Do The Bill proposes to make mandatory the offering of medical payment benefits, accidental death benefits, and disability income benefits in all automobile liability insurance policies.

Our review of the legislative history for H.B. 143 indicates the reasons for passing the legislation included the following:

1. PIP coverage would be a means to lower insurance rates by decreasing the numbers of cases going to court.
2. Passing PIP coverage would help Texas comply with a federal initiative regarding no-fault insurance.
3. PIP coverage would facilitate faster processing of claims
