Abstract

This report reviews development of the sex offender registration program now contained in Chapter 62, Code of Criminal Procedure. It focuses in particular on the legislative histories of S.B. 259 (1991) which created the program.

The House Research Organization analysis summarized S.B. 259 as follows:

Digest

SB 259 would establish a program of registration of convicted sex offenders. It would require registration of person convicted of indecency with a child, sexual assault, aggravated sexual assault, incest, or four cases of indecent exposure. Similar provisions would apply to persons adjudicated guilty of delinquent conduct under any of these sections. Failure to register would be a class A misdemeanor, a third-degree felony for any subsequent offense.

The registration requirement would expire when a delinquent turned 21, or ten years after the offender’s last release from prison or last sentencing.

An offender could petition a district court for exemption for good cause.

The offender would be required to register with the police or sheriff of any county where the offender resides or intends to reside for more than seven days. Prison officials would be required to advise the offender of these requirements within thirty days before release and notify the law enforcement agency where the offender intends to reside. If the offender is given probation or a fine, then the judge would be required to give these notices.

The offender would be required to report any changes of address within seven days. The local law enforcement agency would be required to forward a copy of any registration or report to the Department of Public Safety within three days. The information would be confidential, and disclosure to anyone except a law enforcement officer would be a class B misdemeanor.
