Abstract
In 2005, the 79th Texas Legislature passed S.B. 890 which amended the settlement credit provision of § 33.012, Civil Practice and Remedies Code.
The 79th Texas Legislature enacted H.B. 585, “An Act relating to the requirements for the incorporation of a municipality in the extraterritorial jurisdiction of certain existing municipalities.”
The House Bill Analysis noted the background and purpose of the legislation:
Currently, a municipality may not incorporate in the extraterritorial jurisdiction (ETJ) of another municipality without the consent of the existing municipality unless a petition requesting annexation, signed by a majority of the registered voters in the district and by at least 50 percent of the landowners, is refused by the municipality.
The purpose of C.S.H.B. 585 is to make the petition requirements for the incorporation of a municipality in the ETJ of an existing municipality less stringent than current law requires.
H.B. 585 received public hearings in both the House and the Senate. Floor debate in both chambers was brief. After the bill was amended in the Senate, the House refused to concur and a conference committee was appointed. The Conference Committee Report for the bill was adopted by both chambers. H.B. 585 was signed by the Governor and was effective immediately.
